Commercial Traffic

Sec. 11-9. Through traffic

(a) Through trucking restricted. The use of motor vehicles with a registered gross vehicle weight of more than 12,000 pounds six-ton capacity in and upon the following streets or highways at any time is prohibited., and the chief of police is directed to cause conspicuous signs to be erected on such streets or highways giving notice of such prohibition: Lafayette Road from Oak Hill Road northerly to Colonel Rodman Highway , Featherbed Lane from Hamilton Allenton Road to Annaquatucket Road, and South Road from the East Greenwich town line to Old Baptist Road. The use of motor vehicles with a registered gross vehicle weight in excess of 26,000 pounds in and upon the following streets or highways at any time is prohibited: Fairfield Drive and Peachtree Road. Nothing contained in this section shall affect the use of such streets or highways by any fire truck, town public works department truck, police vehicle, ambulance or other motor truck using such streets or highways in any emergency or engaged in delivering goods, wares, merchandising or materials to or from any residence, building or lot within the town bordering on such streets or highways.
(b) Commercial vehicles prohibited on certain streets. The operation of through commercial vehicles on School Street in the Village of Davisville is prohibited. and such prohibition shall be designated by appropriate signs placed on School Street. The operation of through commercial vehicles on Old Boston Neck Road, from its northern entrance off Route 1A in North Kingstown to South Ferry Road in Narragansett, is prohibited. and such prohibition shall be designated by appropriate signs placed on Old Boston Neck Road. The operation of through commercial vehicles on Clearview Drive from its southern entrance off Old Baptist Road in North Kingstown to its northern terminus at South Road in East Greenwich and the operation of through commercial vehicles on Crest Drive and Midway Drive from its eastern entrance off Old Baptist Road to Clearview Drive is prohibited., and such prohibition shall be designated by appropriate signs. The operation of through commercial vehicles on Fairfield Drive from Peachtree Road to Potter Road, Peachtree Road from Post Road to Fairfield Road, Stony Lane from Huling Road to South County Trail and Old Baptist Road from Ten Rod Road to Davisville Road, is prohibited
(c) Through vehicles prohibited on certain streets. The operation of through vehicles on Plum Point Road, Nautilus Drive, Lorelei Drive, Spindrift Drive, Albatross Drive and Periwinkle Drive in the town is prohibited and such prohibition shall be designated by appropriate signs placed thereon. The operation of through vehicles is prohibited on that portion of Conway Avenue between Northrup Road and Thornton Street., and such prohibition shall be designated by appropriate signs thereon.
(d) For purposes of this section a commercial vehicle is defined as a motor vehicle or combination of vehicles used to transport passengers or property if the motor vehicle; (1) has a gross combination weight rating of twenty six thousand and one (26,001) or more pounds, of a towed unit with a gross vehicle rating of more than ten thousand (10,000) or morew pounds, or has a gross vehicle weight rating of twenty six thousand and one (26,001) or more pounds; (2) is designed to transport sixteen (16) or more passengers including the driver or (3) is transporting hazardous materials and is required to be placarded in accordance with 49 C.F.R. Part 172, subpart F, as it may be revised from time to time.
(e) Nothing contained in this section shall affect the use of such streets or highways by any fire truck, town public works department truck, police vehicle, ambulance or other motor truck using such streets or highways in any emergency or engaged in delivering goods, wares, merchandising or materials to or from any residence, building or lot within the town bordering on such streets or highways.
(f) In all instances where motor vehicle traffic is restricted or prohibited under this section the chief of police is directed to cause conspicuous signs to be erected on such streets or highways giving notice of such.

Re: Proposed Ordinance Changes
Sec 11-9 “Through Traffic”

Please find attached a proposal for changes to section 11-9 of our Town ordinances which addresses “through traffic”.

These changes would:

o Address safety concerns by implementing new restrictions on through trucking of vehicles, which weigh more than 12,000 pounds, on Featherbed Lane, and on South Road (this would restrict vehicles like small dump trucks, small box trucks, and anything larger than those described vehicles)
o Provide an ordinance to substantiate existing restrictive signage that is posted on Stony Lane and Old Baptist Road (pertaining to the operation of commercial through vehicles)
o Delete current restrictions which prohibit through traffic in the Plum Point neighborhood (these restrictions are no longer needed due to the construction of the new Jamestown Bridge and Bridge Road)
o Clean up the language of the current ordinance, making it clearer and more specific by defining a “commercial vehicle” (the proposed wording utilizes the language from Chapter 31 of the R.I. General Laws)
